LatinoJustice Decries "Baldly Politicized" Process to Choose Next NYS Chief Judge
List of candidates for top court head submitted to Gov. Hochul are based on "narrow-minded politics"

New York -- The civil and human rights organization LatinoJustice PRLDEF responded today to reports about the selection process for the list of candidates for Chief Judge for the New York State Court of Appeals that the state's Commission on Judicial Nomination presented to Gov. Kathy Hochul for appointment. 

Three current Court of Appeals judges who are people of color and applied for the position — Jenny Rivera, Shirley Troutman and Rowan Wilson — were left out of the list of candidates presented to the governor, allegedly for the perceived political bent of their decisions.

Gov. Hochul has until December 23 to select her choice for the post.

The following statement can be attributed to Lourdes M. Rosado, President and General Counsel:

“As fierce advocates for courts that reflect our Latino communities and their interests, LatinoJustice PRLDEF promotes having judges who reflect the diverse professional and life experiences of our profession. We’re indignant to learn of reports of a baldly politicized process to manipulate the selection of New York’s next Chief Judge, and the results it has yielded to date.

“Defying decades of precedent and norms that value succession and professional qualifications over narrow-minded politics, the state Commission on Judicial Nomination unjustly passed over three current members of the court who applied for the Chief Judge position. All were previously found eminently qualified to serve with distinction in our state’s highest court. Instead, by all appearances, the Commission has engaged in and carried out back-room deals to put forward a list of candidates chosen based on their alignment to a specific agenda and set of interests.

“The complete lack of transparency in a decision that affects the lives of millions of New Yorker must not be allowed to stand. We must reform the selection process to include input from the public impacted by decisions made in these courts, and remove blatant partisan political interference that shamefully stains this important process.”

Nueva York -- La organización de derechos civiles y humanos LatinoJustice PRLDEF respondió hoy a los informes sobre el proceso de selección de la lista de candidatos a Juez Principal de la Corte de Apelaciones del Estado de Nueva York que la Comisión de Nominación Judicial del estado presentó a la gobernadora Kathy Hochul para el nombramiento.

Tres jueces actuales de la Corte de Apelaciones que son personas de color y postularon para el cargo —Jenny Rivera, Shirley Troutman y Rowan Wilson— quedaron fuera de la lista de candidatos presentados al gobernador, supuestamente por la aparente inclinación política de sus decisiones.

La gobernadora Hochul tiene hasta el 23 de diciembre para seleccionar su elección para el puesto.

“Como fervientes defensores de tribunales que reflejen nuestras comunidades latinas y sus intereses, LatinoJustice PRLDEF promueve tener jueces que reflejen las diversas experiencias profesionales y de vida de nuestra profesión. Estamos indignados al enterarnos de los informes de un proceso abiertamente politizado para manipular la selección del próximo juez principal de Nueva York y los resultados que ha arrojado hasta la fecha.

“Desafiando décadas de precedentes y normas que valoran la sucesión y las calificaciones profesionales por encima de la política de miras estrechas, la Comisión de Nominación Judicial del estado pasó injustamente por encima de tres miembros actuales de la corte que solicitaron el puesto de Juez Principal. Todos fueron encontrados previamente eminentemente calificados para servir con distinción en el tribunal más alto de nuestro estado. En cambio, según todas las apariencias, la Comisión se comprometió y llevó a cabo acuerdos secretos para presentar una lista de candidatos elegidos en función de su alineación con una agenda específica y un conjunto de intereses.

“No se debe permitir que se mantenga la total falta de transparencia en una decisión que afecta la vida de millones de neoyorquinos. Debemos reformar el proceso de selección para incluir aportes del público afectado por las decisiones tomadas en estos tribunales, y eliminar la interferencia política partidista flagrante que mancha vergonzosamente este importante proceso”.
