LatinoJustice PRLDEF Denounces NYS Court of Appeals Failure to Appoint Judge Jenny Rivera as Acting Chief as One That “Smacks of Bias” New York – Only days before Chief Judge Janet DiFiore is expected to step down from her position heading the New York State Court of Appeals, the court has designated one of its newest members as Acting Chief Judge. Historically in accordance with the court’s own past practices, the most senior Associate Judge has been appointed as the interim Chief Judge, who in this case is Associate Judge Jenny Rivera who was appointed to the Court in 2013. The following statement can be attributed to Lourdes M. Rosado, President and General Counsel for LatinoJustice PRLDEF: “Bucking a half-century of Court of Appeals precedent to deny Associate Judge Jenny Rivera the nod to take on the role of Acting Chief when Chief Judge Janet DiFiore officially steps down at the end of the month smacks of bias. Judge Rivera has dedicated her entire career to public service, including nearly a decade of distinguished service on the Court of Appeals. We have no doubt that she is eminently qualified to serve as Acting Chief Judge and would continue her outstanding service in the top seat of our state’s highest Court. Judge Rivera deserves the same opportunity to serve New Yorkers as Acting Chief Judge as generations of her colleagues have previously done, in a tradition of succession respected until now. Only 7.5% of judges statewide are Latino, compared with 17.7% of the population. Adding the perspectives of ‘wise Latinas’ like Judge Rivera or Justice Sonia Sotomayor, for whom she clerked, will clearly help our courts more closely reflect the people most deeply impacted by their decisions.” ### About LatinoJustice
