LatinoJustice Appalled at NYPD Commissioner Decision to Clear Officer in Fatal Shooting of Allan Feliz Despite Misconduct Findings  

New York, NY – New York Police Department Commissioner Jessica Tisch has cleared Lt. Jonathan Rivera of any wrongdoing in the 2019 fatal shooting of Allan Feliz, a Bronx during a traffic stop. 

 
Commissioner Tisch concluded that Rivera acted within department policy, citing the need to protect a fellow officer’s life. 
 
The following statement can be attributed to Andrew Case, Supervising Counsel, LatinoJustice PRLDEF: “Jonathan Rivera shot Allan Feliz in the chest point blank range after climbing into Allan’s car over an alleged seat belt violation. The NYPD Officer who served as a judge in Rivera’s administrative trial considered his testimony on the stand and found him to be lying. Every independent body that has reviewed this incident—the CCRB, the state attorney general, and even the NYPD’s own Deputy Commissioner for trials—has found Rivera committed an egregious act of misconduct. 

  

“The law grants the Police Commissioner final authority over NYPD discipline. But like all public officials, she remains bound by the law. This decision flies in the face of the evidence and the law, was an arbitrary and capricious reversal of Tisch’s own senior deputy and was an abuse of the discretion to impose discipline provided the commissioner under the law.”
