LatinoJustice PRLDEF Celebrates Court Victory Vindicating Birthright Citizenship

New York, NY – The US District Court for the Southern District of New York entered judgment in New York Immigration Coalition, et al. v. Trump, a lawsuit brought by LatinoJustice PRLDEF challenging President Trump’s executive order seeking to end birthright citizenship.

The federal court entered judgment in favor of the plaintiffs and denied the Trump administration’s motion to dismiss the complaint as moot. The court also enjoined the government from enforcing the birthright citizenship Executive Order which the administration issued on its first day in office. The judgment upholds the Supreme Court’s decision last term in Trump v. Barbara affirming a 128-year-old precedent that birthright citizenship is guaranteed to children born on U.S. soil irrespective of parental immigration status.

LatinoJustice filed the lawsuit on behalf of the New York Immigration Coalition, three pregnant mothers, and the Rural & Migrant Ministry. The case emphasized the executive order’s particularly severe impact on Latino immigrant families and children who could have been denied the benefits of U.S. citizenship despite being born in the United States.

The following statement can be attributed to Francisca Fajana, Director of Racial Justice Strategy, LatinoJustice PRLDEF:
“This judgment makes clear that no president can take away a right guaranteed by the Constitution. Children born in the United States are U.S. citizens, no matter their parents’ immigration status. This executive order could have left children without a country and denied them basic documents and services. LatinoJustice is proud to have stood with our clients to protect their rights and safeguard the rightful place of immigrant communities in this country.”
