LatinoJustice says Warrantless Home Entry by ICE Violates Constitutional Protections
New York, NY – The Department of Justice (DOJ) issued a memorandum to federal law enforcement officers titled “Guidance for Implementing the Alien Enemies Act” that states that immigrants they think are "Alien Enemies" are not entitled to a hearing, appeal or judicial review, according to press reports.
The memo also gives enforcement officers authorization to enter the homes of these immigrants, some as young as 14 years of age or older, without a warrant and to apprehend them.
The following statement can be attributed to Andrew Case, Supervising Counsel, LatinoJustice PRLDEF: "America’s rebellion from Britain was driven in part by opposition to 'royal warrants,' authorizations that allowed officers to enter colonial homes without judicial oversight. The Department of Justice memo authorizing law enforcement officials to enter the homes of immigrants without a warrant raises serious concerns of violating the constitutional rights of these immigrants and opens the door for similar policies illegally targeting others in this country without due process.
“The Fourth Amendment, along with state constitutions, protects people from unwarranted and illegal government intrusion into their homes. LatinoJustice will continue to protect and defend the rights our immigrant communities, who are entitled to many of the same constitutional protections as citizens in this country.”
