Two Rushed Supreme Court Decisions on Deportations Grossly and Callously Undercut Due Process for All in the US, Says LatinoJustice

New York, NY – Two decisions issued by the Supreme Court yesterday in response to emergency appeals by President Trump reversed decisions by federal courts on cases related to deportations carried out without due process.

One decision lifted an order from a DC federal judge that halted removal of Venezuelan immigrants that the government deemed as members of the Tren de Aragua gang, without providing credible evidence that they were deportable.

A second decision allowed the wrongful deportation of Kilmar Abrego Garcia to stand while litigation continues, overruling a federal judge’s deadline to return Abrego Garcia to the US by midnight Tuesday.

Abrego Garcia and many Venezuelan immigrants have been deported to El Salvador’s CECOT prison in an unprecedented agreement with the US government.

The following statement can be attributed to Lourdes M. Rosado, President and General Counsel, LatinoJustice PRLDEF:

“The Supreme Court’s use of its shadow docket to grant extraordinary relief to the government in their quest to erode the rule of law grossly undercuts the due process rights to which every person in the US is entitled.

“The Court’s speedy response to the president’s request also callously ignores the irreparable harm that unjust deportation has already wrought on Abrego Garcia, Venezuelan immigrants and others sent to the CECOT prison in El Salvador, a modern-day gulag, and other locations. LatinoJustice PRLDEF will continue to fight for a fair and humane immigration system.”
